It's bad enough when you've been ripped…
It's bad enough when you've been ripped off by an unscrupulous company (Comfortable conservatories) so you contact CAB who suggest Moneyclaim as an option. You then contact them and have to pay them over a £100 to act on your behalf. So they issue a CCJ to them but as the rip off company gave a false address to Companies house a CCJ could not be served. So that's it, no further action is taken. Complete waste of time and money. How MC are a govt organisation beggars belief. Judging by the other reviews, there should be an independent company set up to investigate MC as there doesn't seem to be a single satisfied customer.
Bad, bad bad
The government mcol in my view is not fit for purpose, at best unhelpful and at worst indifferent and useless. In fact everything about it is shockingly bad and the speed at which things happen makes a snail look supercharged. Never, Never, Never again.
It basicly comes down to the fact the law is on the side of the criminal.
If i could provide a lower score i would have
Shoddy useless staff mismanagement …
Shoddy useless staff mismanagement .they send a'form out to stating I havent filled an allocation questionnaire in .I have proof of recorded delivery .then next day .a letter saying something different .with a date on 3days'earlier than the previous letter .appears to me .papers sat in tray on table .kickse seems about right for the system
A useless service
A very poor, unreliable system. The Government Agency is very quick to take your money such as the issue fee and dreadfully slow to provide an efficient service for Court users, be they claimants or defendants.
I have an ongoing claim. Since filing a reply to the defendant’s response 2 weeks ago, I have been unable to open the claim page on the website. It simply defaults to “something went wrong”. It further states:
“Sorry, we had some technical problems during your last operation. Please try again later.”
I am left in the dark. I don’t know what is happening to the claim or if I need to take further steps.
Frankly a useless “service”.
MCOL CCBC call centre not fit for purpose
I try to avoid queuing systems of large companies at the best of times but calling the central MCOL call centre was unavoidable for me because certain things couldn't be done online.
I rang up on a Thursday at 2.50pm needing to pay for a counterclaim. The recorded message said all payments must be made before 3.30pm so I thought I've called in good time. Wrong. I actually got through to talk to someone at 3.29pm and by the time I'd given him my details and he realised I need to pay it was a case of "...sorry sir, the system has just shutdown this second....."
The next day Friday, I was starting to get a little nervous. There are very tight deadlines and if you miss them your case gets thrown out. The best part of all that is they use an antiquated legal system aimed at lawyers that does not tell you when the deadline is! It says something like "....5 days after the date of service..." Is that working days and what is the date of service? Why can't they just tell you the bloody date????
So I rang up this time at 12.30pm giving I thought plenty of time to make the payment. After about 40 minutes I got through, it was confirmed I was not too late to make the payment and then "...I'll just put you through ok? " Rhetorical question since no chance to answer it. Then the phone started ringing as per a normal dial tone - no music this time. Eventually after 5 further minutes of that, I got the dreaded beeeeeeeeeeeeeeep.
Time to call again and I was getting really anxious. Why won't they take my money? Are they trying to reduce their caseload by having people fail their deadlines? Final attempt I got through and when I finally got through to the guy who actually takes the payment I felt like I was incredibly privileged just to talk to him it was such a relief.
I have to say everyone I've spoken to there sounds a bit like they could do with some commercial customer service training. Despite me being as polite as pie (not to cause anymore problems!) they come across as very sullen.
Defenders perspective
Defenders perspective
This scheme is biased. It allowed a claimant to take out a claim against me with no grounds in law. He was basically trying to sell me a faulty item. When I got my money back he tried to use this system to get the refund back from me. When he realised he had no grounds he told the money claims I had settled and paid in full which was a total lie.
The system does not allow the defendant to respond. So it looks like the claimant is always right. I managed to get through to an adviser after two days of 40 min waiting
Who basically said. Anyone can make a money claim as long as they pay the fee and fill the forms.
Seems to me this system need completely
Redesigning.
I went through two month of Hell for buying damaged goods from a dodgy seller who then tried to use the court system to prove I knew i was buying damaged goods so should give my refunded money back.
This system allows people to use the system to abuse customers. Then lie, and say I settled in full out of court.
Phone system is useless and keep dropping people off after a long wait.
At the outset the process seemed simple…
At the outset the process seemed simple and straightforward. However, it soon became very protracted - even getting through on the phone was almost impossible (regularly waiting 45 mins!); emails were never answered and the County Court contact phone line offered was even worse. Despite phoning umpteen times at 8.30 as recommended for several weeks, i only once got through. The weeks went by and eventually the case was allocated to the Bailiffs. However, except for their one daytime visit and one phone conversation with the defendant, there was no result.
After many weeks of frustration at getting no progress, I applied to have the CCJ elevated to a High Court Judgement, (which I now realise I should have done earlier) and used a well known debt collection bailiff company. Within ten days, and after just two (this time out of normal hours) visits, they got all the monies owed to me
including all the fees I had paid from the beginning to completion.
Money Claim Online is, nevertheless, a way of giving the layperson fairly inexpensive access to officially and legally getting a debt paid. It is also a route to successful High Court Enforcement, that has far more success. It just needs to get its phone contact service sorted out, reply to customers emails and appoint bailiffs more quickly to their cases.
The money claim system is biased and very flawed...
The money claim system is biased heavily towards the claimant and does not provide adequate support for defendants. Not all defendants are wrong! The help materials should be more balanced. There's lots of information about how to claim, what happens from the claimant's point of view, but much less information about how to defend and what the process should be. It does not explain timescales clearly. It's geared up for making a claim, not defending a claim.
Secondly, the help desk phone line is utterly useless. If you phone any time after 9am, you are placed in to the queue at position 20+. It takes around 10 minutes to clear ONE call. So expect a very very long wait.
I phoned at 8.30 exactly when the line opens and was already at position 9. I waited 41 minutes to get to position 5 and then the system hung up on me!
Good luck!
Waste Of Money
Started process in April. In July I paid for a CCJ to be issued. In August I paid for a Warrant Of Control. It is now November. I have heard nothing. I keep phoning 0300 123 5577 to chase on progress. Only to be told someone will phone you back. No one has phoned me back. I’ve paid nearly £200 in fees for a service. A service I have not received. What has happened to the Warrant Of Control that I paid for and submitted. I have found this service to be completely un helpful and I’ve wasted more money for a service that I have never received. Very un-happy and feel very let down.
System crashed
System crashed
After writing a long defence to a claim the system crashed and then stopped me logging back in.
The whole process is floored
The whole process is floored from the onset, I paid the fees to process the claim through court and paid additional fees for a warrant and bailiffs, the bailiffs sat on the warrant for three months allowing the defendant to relocate his business.
The court looking after my case do not return my calls even though they where happy enough to take my money. Who is worse the defendant for not paying up of the justice system that allows the defendant to run. What a joke!!!!!
