RPT Wales LVT and Judge Colin Green
RPT Wales LVT is part of the UK courts and tribunal service in the name of King Charles III.
We recently engaged in a tribunal that lasted from June 2022 to June 2024. The results were mixed.
The first thing to know is that this was a LVT (Leasehold Valuation Tribunal) dealing with service charges to leasehold properties. The mandate and authority of this tribunal service as part of HM Courts and Tribunals Lands Chamber is extremely limited and at the end of the process they can only make a determination, but have no enforcement powers. A successful applicant to the tribunal must next take their judgement to a higher court, County Court or High Court to be able to enforce the determination if the respondent, typically a landlord or a RMC (Residents' Management Company), ignores the outcome of the tribunal and effectively disregards the finding of the panel and the presiding judge in the case.
Another thing to note is that whereas the RMC is the 'new' landlord, this may be the real landlord's way of avoiding direct responsibility and evading the law and the hiding landlord's legal responsibilities. I call RMCs a firewall between leaseholders and those with the money and a duty of care. An RMC typically has zero assets and operates as a dormant company and is merely a money pass through organisation.
In our case the RMC was not only a firewall with no assets, it had no means to directly make contact as the directors used a law firm as a post rèstante and it did not actually receive our money as it did not even have a bank account, instead our money went directly into the property manager's account in violation of the management agreement between the landlord and the property manager, but that is largely because the landlord and the directors were AWOL or absented themselves from 2017 until this year (2025), so as they failed to hand over the RMC to the residents of our development, the property manager was able to act as the proxy landlord and make errors ad infinitum that I allege was fraud. RPT Wales LVT, something of a trojan horse organisation insisted on calling 10 years of the same conduct 'errors' as they were averse to referring to the property manager's conduct as fraud or alleged fraud.
In short tribunals of this kind are a placebo court process as they typically do not deliver justice to the applicants, and here another note, I have been told any number of times that courts are not in the business of delivering justice, they merely interpret the law, but if those laws are weak, poorly constructed and sanctions are essentially worthless, an applicant who wins their case can end up with what appears to be a win, but a win accompanied by a much bigger loss as tribunals often, perhaps usually award the responding landlord or RMC their costs spent on solicitors and barristers attempting to defend a rogue client against British citizens who naively think they are going to get justice, but find that the tribunal awards costs in proportion only to the ratio of the determination, which to explain means if the applicants attempt to correct ten issues, but are only successful with 5 of these or fewer than 5, the tribunal will almost certainly award the landlord/RMC as respondent 50% or more of their costs, which could mean a favourable determination for say £10,000 in favour of the applicants, but a costs award of 50% of £100,000 which effectively amounts to a loss or cost against the applicants for £40,000 which will later appear as part of their future service charges.
In short this tribunal service is a big risk and amounts to some would say a reckless gamble, but the flipside is that Parliament has done such a poor job of legislation to protect leaseholders over the decades that this part of British law is an invitation to rogue organisations to exploit both the weakness of laws and opportunities to commit fraud that the tribunal service likes to call errors, but as mentioned these are the same errors that appear year after year in the accounts and management by rogue property managers, and many UK property managers appear to fall into this classification.
So how did things go for us. First we were awarded about one third of our claim, which in round numbers came to £50,000 although we say iot should have been £500,000 including interest, but again tribunals cannot award the interest that courts commonly do award. Of course our landlord ignored the findings of the tribunal and had contempt for the determination, but were awarded 70% of their costs which in total came to £130,000 so in essence we won but we lost, and the case took so long that by the time it was over, the world and the date had moved on, so we believe our claim or our case now amounts to us being owed £1 million including interest.

I engaged Tom Street and Co Solicitors at a very late stage for an employment tribunal that I had no clue about how to prepare for. I had negative experiences from other solicitors that I had contacted as they were demanding ridiculous amounts of money.
