I purchased a pair of waterproof leather boots over the internet which leaked as did a second replacement pair. When I had to send the second pair back I asked them to collect as I legally shouldn't have to pay the postage. They agreed but the next day rang & said they couldn't get the collection website to accept my address so could I organise it from my end and they would reimburse me. This I did and two weeks later received a third pair of boots along with a copy of my letter to them with " no postage refund to be issued, customers responsibility to get boots back to us" written across it. I rang & spoke to them having first checked with trading standards but they still refused to refund my £30 postage.
The 1979 sale of goods act states "section 48/2 If the buyer requires the seller to repair or replace the goods the seller must b) bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage)
The company owner's attitude to this when I pointed it out was that he didn't agree and wasn't refunding it. I have since had the postage refunded to me by Barclaycard (as a goodwill gesture only) and so wont take it any further, small claims being the only other alternative and a lot of hassle plus possible costs. B/Cards advice for future ref is that I should have got their agreement to refund the postage in writing and then gone through Barclaycard for the refund.
My local trading standards office have checked their website and tell me their terms and conditions do not comply with the law and have reported them to their local TS office.
I have my money back now, though only after typing many letters and making numerous phone calls all costing time and money, but still feel infuriated that these people can get away with flouting the law in this way and creating hassle for honest customers.
