The process was smooth at first
The process was smooth at first. My trademark search looked good and after being approved by a trademark official that should have held weight. But it was opposed by a company that has zero of the same products- not even close. Not one item. Surprisingly, Trademark factory left me to defend myself, they said it would be costly and I should come up with a new name. This surprised me because, it was approved by an official from the US Tradmark registry??? After I researched trademark factory and how to get help i learned the name of a trademark attorney connected with the trademark factory and reached out. He was very helpful and patient. I am grateful as well that he gave me a good rate because the trademark factory didn't help at all, I thought they would be with me every step.of the way - especially since it was approved initially. They suggested I find a new name. But I already had a logo that was established. Anyway, I had to drop some of the items - the main items I wanted to trademark because I didn't have the funds to go to court. So I compromised. If I had money to fight I know I would have won. I had the name almost 20 years longer and they do not sell one item that I do. If none of that happened - it would have been smooth. I also think that if the application was filed as 'in use' instead of 'intent to use' it may not have been opposed. But somewhere there was a miscommunication during the filing, I missed it as well.
Now going forward, I hope that trademark factory will prove to be helpful in monitoring and maintaining the mark.

I definitely made the right decision on…
I definitely made the right decision on choosing Trademark Factory to represent my brand. We filed in both USA & Canada and actually got a confusion rejection on the USA side but Adriano Pacifici put together an INSANELY good appeal letter and the USPTO reversed the decision!! Typically, the odds of having a confusion rejection reversed is less than a 5% chance, usually near impossible. I literally called Adriano and told him how much this company trademark meant to me and I had faith in him to put together an appeal letter as best as he possibly could. Pretty sure he could sense the sadness in my voice at the time, and he assured me that he will do the best he possibly could to have the decision reversed. I kid you not, it was literally the best appeal letter I've ever seen! After reading it, that letter even gave me a feeling of confidence again and no matter the outcome, he covered every aspect possible to hopefully change the examiners mind and respectfully reverse the refusal rejection. Lo and behold, it worked! We are now trademark approved in both Canada & USA and now I can sleep at night knowing that I can continue with growing the brand I created from the get go. I chose the all inclusive option because I had a feeling we were going to hit a couple speed bumps along the way. It was definitely worth the little extra money so I knew exactly what to budget for, even if there was several office actions, they still responded with no additional costs! I absolutely LOVE this team of Intellectual property Lawyers / specialists. Thanks for all your hard work 😘

Never Outsource Thinking: Most Attorneys Play It Safe (and Lose)
I was genuinely disappointed with the service. The search I paid for turned out to be something I could have easily done myself through the USPTO.gov site—something I had, in fact, already completed. I was led to believe that this service would be more thorough, yet the results mirrored my own search exactly.
The firm ultimately warned against moving forward with my trademark application, citing that the name was already taken. When I reached out to explore alternative options—such as pursuing a trademark cancellation for non-use or negotiating a coexistence agreement—I was met with a blanket recommendation against these approaches. One of their primary reasons was that the current trademark owner had "recently submitted renewal documents with evidence of use."
However, upon conducting my own research, I discovered that the trademark in question had not been actively used since 2020. More concerningly, the renewal documents submitted contained the exact same materials that were used in 2019, with outdated timestamps. Armed with this information, I have now engaged an experienced attorney to file a Petition to Cancel with the Trademark Trial and Appeal Board, and I feel confident in my case.
The takeaway? If you are serious about securing a trademark, do your own due diligence rather than relying solely on legal consultants who may not be willing to dig deeper. In my experience- across multiple areas of law, including family court, criminal law, personal property and trademark matters—attorneys often take a surface-level approach rather than investing real effort into crafting a winning strategy. This experience was yet another disappointment, and a mistake I won’t make again.
Moving forward, I will conduct my own research first and then interview attorneys based on the strategy I believe is best for my case. I will hire only those who demonstrate a clear understanding of my approach and can convince me they have confidence in a path to success.

We understand that navigating trademark law can sometimes feel frustrating, especially when there are obstacles with an existing trademark. Our team always aims to provide the most realistic, risk-aware guidance possible. In this case, our recommendation against moving forward was based on our "play it safe" approach, which is exactly why we’ve helped over 4,000 clients secure their trademarks with a 99.3% success rate.
While cancellation actions or negotiating coexistence agreements can sometimes be successful, they are always a gamble and, more importantly, take time. That’s why we generally do not recommend filing for a name that is already trademarked, even if there’s a chance the other mark could eventually be canceled.
That said, our advice is never a barrier to action. You were always free to instruct us to move forward despite the risks. Our attorneys could have pursued the same approach you are now taking with your new attorney—we simply would not have recommended it as your best option.
Ultimately, our goal is to give clients the full picture, including the safest path forward, so they can make informed decisions. We wish you every success with your cancellation proceedings and hope your trademark journey ends on a positive note.
