Xiaomi Official Support Service Disastrous: Phone Returned Worse and No Response
I sent my Xiaomi Mi 10 5G EEA for service at ESD ROM , an official Xiaomi authorized service center in Romania, due to network instability and performance issues. The device was under warranty .
When I returned from the repair, the phone was seriously damaged :
Totally unstable network
Hardware malfunctions (presumed damaged motherboard)
New problems not present before the surgery
🔇 Despite numerous reminders via email and PEC, I have never received any concrete response from ESD ROM or its management .
The behavior has been one of total silence and complete negligence , despite the obligation to guarantee a compliant after-sales service.
📌 Serious violations:
Directive 2019/771/EU – art. 11 : warranty assistance must be free, effective and timely . Here, the damage has been increased , not resolved.
Romanian Civil Code – art. 1.270 et seq.: breach of contract, aggravated by hidden defect caused by the repairer .
Directive 2005/29/EC – unfair commercial practice : unjustified refusal to respond or propose solutions to the consumer.
Breach of the duty of professional diligence (art. 5, Dir. 2005/29/EC).
⚖️ Favourable EU case law:
CJUE, C-65/09 and C-87/09 (Weber and Putz): if the repair is not effective, the consumer can ask for replacement or reimbursement.
CJUE, C-32/12 (Duarte Hueros): even the authorised assistance is liable for the failure to repair.
Italian Civil Court, Section III, Sentence No. 18491/2016: the assistance centre is liable if it aggravates the damage or does not restore functionality.
📌 ESD ROM has ignored all my communications, causing technical and financial damage without offering any form of remedy or contact.
As an authorized Xiaomi center, their conduct is unacceptable.
I absolutely advise against entrusting your devices to ESD ROM. A worsening repair is equivalent to damage, not service.
