Trading CFDs through AvaTrade's Islamic accounts is not Shariah-compliant and the broker lacks independent Islamic certification or auditing. While AvaTrade brands its Islamic account as "swap-free", it lacks the structural frameworks required by mainstream Islamic finance:
1. CFD Trading is not Shariah-Compliant:
According to the consensus of major Islamic jurisprudence bodies have ruled that CFD trading is Haram (impermissible):
• No Asset Ownership: CFDs are "Contracts for Difference". You are purely betting on price speculation without ever owning, taking possession of, or delivering the underlying asset.
• The "Swap-Free" Loophole: While AvaTrade eliminates the Riba (interest) aspect of overnight swap fees, this only fixes one structural problem. The underlying contract mechanism itself remains non-compliant.
• Time Limitations: AvaTrade enforces a 5-day to 10-day limit on its swap-free accounts depending on your specific jurisdiction. If you hold a position past this grace period, overnight interest fees (swaps) are charged, violating the absolute prohibition against Riba.
2. No Regulating Islamic Certification Body:
There is no external Islamic regulatory body that certifies AvaTrade and its Islamic account is a self-certified product. It has not been vetted, endorsed, or issued a Fatwa (religious decree) by any globally recognized Islamic finance board or authority.
3. No Third-Party Shariah Auditor:
AvaTrade does not undergo an annual third-party Shariah audit and it does not employ or contract independent Islamic financial auditing firms to review its product lines.
4. No Shariah-Compliance Department:
AvaTrade does not have a dedicated internal Shariah-Compliance Department. Requests to convert a standard account to a swap-free account are handled by their standard secular compliance and customer support teams. There are no internal Shariah scholars or Islamic jurists overseeing day-to-day operations or managing contract frameworks to ensure strict adherence to Islamic law.
